‘Naughty little girls’ lied about rape, spanking claims: Defence
Drunk, disobedient and facing the wrath of their parents, two “naughty little girls” concocted rape and spanking stories to escape punishment, a defence lawyer alleged Tuesday.
The accusations came after a 17-year-old old girl tearfully told how Antonio “Anthony” Comunale and girlfriend Caroline Budd used her as their teenaged “sex slave” during a night of boozing and marijuana in May 2014.
And on Tuesday a second complainant, now 18 years old, testified that Comunale pinned her down while Budd spanked her with a wooden stick — a chilling copy of the prelude to the first witness’s alleged rape.
Comunale, 32, and Budd, 21, have pleaded not guilty to counts of sexual assault and forcible confinement.
Comunale’s lawyer Gary Barnes suggested to both girls that crying rape would win them free passes from their furious families.
“You’re a victim then,” Barnes said to the first witness. “You’re not a naughty girl any more.”
“There’s no way I would make up a story to get out of a week’s grounding,” the teen, who can’t be named, retorted.
“It gets you out of the trouble you’re in, doesn’t it,” Barnes said.
“I’m sorry, I don’t really care to get in trouble. She’s my mom. She’s gonna love me anyway,” the teen said.
The second girl testified she and the first teen returned to Budd’s home days after the first teen was allegedly bound, gagged and sexually assaulted.
She was drinking alcohol when Budd said she deserved “50 spanking” for being late for school.
“It was really weird and twisted,” the girl said.
They hiked her skirt up and then her shorts to expose her rear; Budd spanked her with an open hand then grabbed the stick, the girl said.
“I was begging them to stop,” she said.
She was distraught and went to the bathroom with the first complainant, who told her a bit of what Budd and Comunale had allegedly done to her.
But they decided to stay for a little while longer and the teen kept drinking until she blacked out.
She awoke in her own bed — with her bra in her backpack and no recollection of how it got there.
“Up to this time you’d been a couple of naughty little girls,” Barnes said. “You know you’re in a lot of trouble don’t you.”
“Yeah,” the girl said.
“You gotta tell (your parents) something, don’t you,” Barnes said, suggesting she met up with the first complainant later that day to “get your stories straight.”
The girl denied it.
She was regularly in trouble, she said, and she wouldn’t jeopardize a source of free liquor for nothing.
The court also heard from the girl’s father, who tracked her down and peeled the passed out teen off the floor of Budd’s basement, which stank of pot.
Comunale discouraged him from calling 911 though the girl was nearly unresponsive.
The father eventually got her home and helped the leaden girl up the stairs.
She tripped. Her dress flew up, exposing her buttocks.
Her rear was “as red as can be,” her father said.
