Local elementary teachers’ union promises no one-day strikes Oct. 1
A lawsuit filed by the City of Ottawa against R.W. Tomlinson construction company over a paving job on the Mackenzie King bridge is heading to trial Monday.
In a statement of claim filed in March 2011, the city said R.W. Tomlinson didn’t properly pave the bridge behind the Rideau Centre in August 2008, which led to water leaking into the National Arts Centre parking garage and deterioration of the roadway.
The city got another company to redo the paving job in 2009 and is suing R.W. Tomlinson for $690,000 to cover the cost of the second job, alleging they failed to properly prepare the bridge and didn’t use an asphalt mix that was appropriate.
In its statement of defence, R.W. Tomlinson said the city suggested using that asphalt mix despite never having used it before and sole-sourced the contract.
Chase Corporation, who designed the hot asphalt mix, is named as a third party in the lawsuit and says it warned the city about using that particular mix on the bridge.
None of these claims have been proven in court.
Eight to 10 days have been set aside for the trial in the Ottawa courthouse.
