‘Ottawa’ Attorney General Launches Appeal After Man Granted New Trial in Bar Beating
Nearly 12 years after Brian Fudge’s killing, the courts are still trying to figure out who is responsible for taking the 22-year-old’s life.
His alleged killer, Charlie Manasseri, was found guilty in 2012 of second-degree murder and won an appeal earlier this year to present new evidence he claims will clear his name.
But now the attorney general of Ontario is seeking leave to appeal to the Supreme Court of Canada, throwing another twist into the decade-long legal saga. It says the appeal court has opened the door to lawyers resurrecting evidence on appeal that they purposefully chose not to present at trial.
On New Year’s Eve 2004, Fudge was at Le Skratch bar on Merivale Road, celebrating his birthday. When he went to order a drink he got into a spat about who should be served first with Manasseri, who then smashed his head repeatedly on a steel surface at the bar.
