Rape kit evidence inconclusive
Two teenage girls who say they were treated as sex slaves waited too long to have rape kits administered for the tests to be conclusive, a court heard Thursday.
A total of five reports were completed on the two teen girls, who can’t be named due to a publication ban, after they alleged Antonio “Anthony” Comunale, 32, and Carline Budd, 21, forcibly confined and sexually assaulted them in the spring of 2014.
One of the girls alleges she was raped with a sex toy, tied up and spanked on her bare skin with a metre-stick after a night of partying at Budd’s house.
Her samples were collected May 22, 2014, four days after the alleged sexual assault.
“Too much time had passed to make a relevant sample for testing,” said prosecutor Mark Moors.
The biology tests returned without adequate traces of foreign DNA needed to confirm an assault.
